For premium PVC marquees and/or accessories, the security deposit is €100–€200, depending on the size and quantity. The security deposit for a premium pagoda tent is €200.
Pay the security deposit on collection, in cash or by debit card. The deposit will be refunded in full when all items are returned complete, undamaged and in accordance with the return conditions. All crockery and cutlery must be returned clean. Table covers and tablecloths do not need to be washed. Deposits paid in cash are refunded in cash. Deposits paid by debit card are refunded to your bank account on the day you return the items. Costs arising from damage, dirt or loss will be deducted from your deposit.
Article 1 – Application of the hire terms and conditions
These hire terms and conditions apply to all agreements entered into by the hire partner of Partyverhuur Zuidplas, hereinafter referred to as “the Hire Company”, and to all agreements to which that hire partner is a party, unless the parties have agreed otherwise in writing. No other terms, including the customer’s own terms, apply to these agreements, even if the customer has expressly referred to them.
Article 2 – Formation of agreements
An agreement is formed when the Hire Company accepts or confirms an instruction or order in writing or by email. Any additional arrangements made by the parties after the agreement is formed apply only once the Hire Company has confirmed them in writing.
Article 3 – Termination of agreements
An agreement ends when the agreed hire period expires. The Hire Company may terminate the hire agreement if the customer fails to fulfil the agreement; if the customer’s business is subject to a suspension of payments, bankruptcy, cessation of operations or liquidation; or, if the customer is a consumer, if the customer is placed under legal guardianship or becomes subject to the Dutch Debt Restructuring (Natural Persons) Act. Termination by the Hire Company does not affect the Hire Company’s right to compensation for costs, loss and interest.
Article 4 – Reservations and cancellations
You can cancel your reservation by email to boy@partyverhuurzuidplas.nl or via WhatsApp on 06-28733986. Please include your name and order number. The notice period is determined by when we receive your cancellation and the agreed start of the hire.
At least 7 days before the hire starts: cancellation is free of charge.
From 48 hours to less than 7 days before the hire starts: up to 50% of the hire charge.
Less than 48 hours before the hire starts, or if you fail to collect: up to 100% of the hire charge.
We do not charge a separate reservation fee. The security deposit is refunded in full on cancellation. Delivery and assembly that do not take place are not charged automatically; only demonstrable costs that can no longer be avoided may be passed on.
The percentages stated are maximum amounts. Cancellation charges are limited to reasonable, substantiated compensation for losses incurred and lost profit. We take account of costs saved and income from hiring the items to someone else.
Any statutory right to a cooling-off period or termination without charge remains unaffected.
Article 5 – Security deposit
The customer must pay a security deposit for each hire agreement unless otherwise agreed in writing. The Hire Company sets the deposit in proportion to the stated hire period and the value of the hired items. If the customer wishes to extend the hire period, a new security deposit must be paid no later than the day of the extension. If the customer does not pay the required deposit, or pays it late, the Hire Company may terminate the hire agreement unilaterally, without prejudice to the right to damages.
The customer must not treat the security deposit as an advance payment of the agreed hire charge. At the end of the hire agreement, the Hire Company may set off the deposit against any outstanding hire charges.
Article 6 – Hire periods
For standard hire items, the price shown includes 4 calendar days of hire. Both the start date and return date count; Friday to Monday, for example, is 4 days. Each additional hire day selected in advance, from the fifth day onwards, incurs a surcharge of 25% of the items’ hire price. For pagoda tents, this surcharge applies to the full product price, including the assembly and dismantling included in that price. Separate assembly services, gas, security deposits and delivery charges are excluded from the surcharge calculation. The surcharge is calculated automatically from the selected dates when ordering and is shown separately before payment. The agreed hire period and return date are stated in the confirmation. Article 12 applies to late returns after the agreed hire period.
Floral arch exception: the hire price is €250 for one day, including installation. A separate installation appointment will be arranged. The hire period of other items does not affect this amount; no additional-day surcharge is calculated for the floral arch. Delivery costs are additional. Installation and collection times are agreed separately.
Article 7 – Customer’s risk and obligations
The customer bears all risk for the hired items from the time they are received. The customer must take the necessary safety and care measures when using them. Separate operating instructions apply to various items, including marquees and bouncy castles. The customer must follow these instructions, which form an integral part of these terms. The instructions can be found in the bag containing the fastenings.
Where necessary, the customer is responsible for obtaining any permissions, permits and exemptions required to use the hired items. Any loss arising from failure to obtain them is entirely at the customer’s expense.
The customer may sub-hire the items or make them available to third parties only with the Hire Company’s written permission.
When collecting the hired items, the customer must be able to show a valid passport, driving licence or identity card.
Article 8 – Delivery, collection, assembly and dismantling
The Hire Company can deliver hired products to the venue for a transport charge. The customer determines where the hired items are to be installed and must check and warrant that installation at that location is safe, will not damage anyone else’s property and will not infringe anyone else’s rights. The customer must inform the Hire Company of any pipes, cables, conduits or other installations on or below the ground. The installation area must be horizontal and level. The Hire Company may require the customer to specify a different location if the proposed location appears unsuitable, unsafe or at risk of causing damage. The customer cannot bring a claim against the Hire Company for exercising this right. The customer warrants that, on the agreed delivery and/or assembly date, the area will be entirely clear and accessible, without stairs or different floor levels, and accessible by vehicles, including heavy lorries. Any arrangements required to achieve this are entirely at the customer’s expense. Damage to the site, buildings, pipes, conduits or other objects on or below the ground resulting from installing the hired items or leaving them in position remains at the customer’s expense.
Article 9 – Damage and loss
Damage to hired items must be reported to the Hire Company immediately upon discovery and no later than 48 hours after it occurs. The customer is liable for damage of any kind to the hired items and bears all associated costs, including repairs.
If the estimated damage exceeds €500, the customer agrees in advance that an assessment will be carried out at their expense by an assessment firm appointed by the Hire Company. For estimated damage below €500, the Hire Company will carry out the assessment. All costs of assessing the damage are payable directly by the customer.
In the event of theft and/or loss, the customer must pay both the agreed hire charge and the replacement value of the hired items as new.
Loss or damage suffered by third parties, whether or not caused by the hired items, is entirely at the customer’s expense. The customer is advised to take out event insurance.
Article 10 – Inspection of hired items
To avoid problems, the customer must inspect the hired items immediately upon receipt and report any defects, missing items or other complaints to the Hire Company without delay.
Article 11 – Risk during loading and unloading
The customer bears the risk of loss or damage to the hired items throughout the hire period, including during transport carried out by the customer. The customer must pack and load the items appropriately for their nature and the method of transport.
The Hire Company can deliver and install the hired items. This must be arranged separately if required. Delivery and installation by the Hire Company are subject to a charge.
Article 12 – Returns
All crockery and cutlery must be returned clean. Table covers and tablecloths do not need to be washed and are exempt from the cleaning requirement below.
Hired items must be returned on the agreed return date or be ready for the agreed collection service. The customer must observe the Hire Company’s opening hours.
If hired items are returned after the agreed hire period has expired, the customer is automatically in default by operation of law and incurs an immediately payable penalty of 25% of the hire charge per day.
Hired items must be returned in the condition in which the customer received them. If, after return, items are found to be damaged or inadequately cleaned, the customer is liable for the resulting loss and costs incurred by the Hire Company.
Article 13 – Payment
The hire charge is paid using the payment method chosen when ordering and cannot be paid in cash. The security deposit may be paid in cash or by debit card, as described at the start of these terms. If the Hire Company and the customer agree to payment against invoices issued by the Hire Company, the customer must pay within fourteen days of the invoice date. If payment is not made on time, the customer is automatically in default without further notice. In that event, the Hire Company is entitled to statutory interest and all judicial and extrajudicial recovery costs, without prejudice to the right to the agreed hire charge.
Article 14 – Disputes
All disputes arising from or in connection with an agreement with the Hire Company will be heard exclusively by the competent court in the Hire Company’s judicial district, applying Dutch law. The Hire Company reserves the right to bring proceedings against the customer at the customer’s registered office or place of residence.
